Mian Muhibullah Kakakhel Senior Advocate Supreme Court of Pakistan and Managing Partner of Kakakhel Law Associates submitted power of attorney to defend Emirates Airlines in a damages case and also filed an application for rejection of plaint under Order 7 Rule 11. The plainttif who sued Emirates was stopped and his visa was cancelled by the UK Immigration Officer in Dubai.

He wanted to proceed to Manchester, UK but due to cancellation of visa he was sent back to Peshawar. He instead of filing an appeal to the UK Immigration, filed damages suit against Emirates Airlines in Peshawar.

In the court Mr. Kakakhel contended that its Immigration matter and Emirates Airlines are only service provider. Visa is granted by the Embassy and can any time be rejected at the Airport by the UK Immigration Officer.

He also told the court that he was using two passports one was valid and one expired. The visa on which he was travelling was previously cancelled by the Immigration Officer but the decision was subsequently changed. This time when he was trying to visit Manchester on the same visa, the immigration officer cancelled it as the previous decision of the officer was not according to the immigration law and he had no authority to allow a person to enter UK with a cancelled or Stamped visa.
