An apostille verifies the signatures and seals contained within a legal document whereas notarization witnesses and certifies the authenticity of signatures.

An apostille is a document that verifies that the signatures and seals contained within a document are legally valid and can be accepted as such internationally whereas notarization witnesses and certifies the authenticity of a document’s signatures.

Both apostille and notary guarantee the legal validity of a signed document, an apostille and notarization are not the same procedures. The main difference between the two is that notarization ensures a document will be accepted as legally binding within Pakistan as long as it is notarized according to the governmental guidelines where the document is signed. On the other hand, an apostille guarantees that a document signed and notarized within Pakistan will be valid and accepted in any country participating in the Hague Convention of 1961.

Apostille Service of Documents

Apostille is a specialized certification that authenticates public documents intended for use in countries that are parties to the Hague Convention 1961. It is issued by a designated authority in the country where the document originates and is recognized by all other member countries of the convention.

An apostille is essentially a certificate attached to the original documents by the competent authority in the issuing country. This certificate confirms the authenticity of the signature, the identity of the person signing the document, and the validity of any stamp or seal affixed to it.

In Pakistan, the Ministry of Foreign Affairs (MOFA) is responsible for overseeing this procedure. The implementation of the Apostille process in Pakistan is expected to commence in the coming months upon completion of the necessary requirements and steps. Until then, standard legalization procedures through MOFA will remain in effect.

As a contracting state of the Hague Convention, Pakistan's relevant authorities will now accept Foreign Apostille Certificates issued by member states of the Convention without requiring additional attestation from MOFA or Pakistani Embassies abroad.

Notarization Service of Documents

Notarization is a process where a licensed Notary Public verifies and authenticates a document by witnessing and certifying the signatures on it, ensuring legal assurance and preventing fraud. A Notary Public is a government-authorized legal professional responsible for this task.

The process involves verifying the identity of the person signing the document and ensuring its authenticity. The Notary Public confirms that the individual signs the document voluntarily and without coercion. Once satisfied, the Notary Public affixes their official seal and signature, certifying the document's authenticity and the identity of the signer.

Common documents notarized in Pakistan include affidavits, power of attorneys, and contracts, often required for legal or official purposes.

It's important to distinguish notarization from legalization, as they are separate procedures. Notarization verifies the document's authenticity and the signer's identity locally, while legalization is an additional step necessary for using documents internationally.
